1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Wizify® mobile application (the "App") provided by Wizify LLC ("we," "us," or "our"). By downloading, installing, or using Wizify, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the App.
2. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting updated Terms in the App
- Updating the "Last Updated" date
- Sending an in-app notification or email
Your continued use of the App after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and may delete your account.
3. Eligibility
3.1 Age Requirements
You must be at least 13 years old to use Wizify. Wizify is a general audience app not intended or directed to children under the age of 13.
If you are between 13 and 18 years old (a "minor"), you must have permission from a parent or legal guardian to use the App and agree to these Terms.
3.2 Account Accuracy
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
3.3 Prohibited Users
You may not use the App if:
- You are not legally permitted to use the App in your jurisdiction
- Your account has been previously suspended or terminated
- You are prohibited by law from receiving our services
4. Description of Service
Wizify is a habit tracking and personal development application that helps you:
- Create and track daily habits
- Monitor progress with analytics and insights
- Integrate with Apple Health for activity-based habits
- Set reminders and goals
- Access premium features through subscription
- Connect with friends and share progress (optional social features):
- Follow friends and view their habit progress
- Share your habits, streaks, and Apple Health metrics with followers
- Control who can follow you (private profiles require approval)
- Block or mute users at any time
- Important: When you allow followers, they can see your health and activity metrics unless you hide specific metrics via Privacy Settings (see Privacy Policy Section 6.4 for details)
The App is provided "as is" and may be modified, updated, or discontinued at our discretion.
5. User Accounts
5.1 Account Creation
To use Wizify, you must create an account using:
- Apple Sign In (recommended)
- Email authentication (where available)
5.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
We are not liable for any loss or damage arising from your failure to protect your account.
5.3 Account Termination
You may delete your account at any time through the App Settings. Upon deletion:
- Your personal data will be immediately and permanently deleted (email, profile, habits, social data, etc.)
- Financial transaction records will be anonymized and retained for 7 years (required by tax law)
- Active subscriptions will continue until the end of the current billing period (no pro-rated refunds)
- You will lose access to all content, features, and in-app currency
- Deletion is immediate and irreversible - there is no recovery option
We reserve the right to suspend or terminate your account if you violate these Terms.
6. Subscriptions and Payments
6.1 Subscription Plans
Wizify offers optional premium subscriptions with enhanced features:
- Plus Plan: Mid-tier subscription with additional features
- Pro Plan: Full access to all premium features
Subscription details, pricing, and features are displayed in the App and subject to change.
6.2 Payment Processing
- Subscriptions are processed through RevenueCat (our payment processor) and Apple's App Store
- RevenueCat manages subscription infrastructure, while Apple handles all payment transactions
- Your payment information (credit card, Apple Pay, etc.) is processed and stored by Apple
- We never receive or store your payment credentials - all payment data is handled securely by Apple
- You will be charged the subscription fee at the start of each billing period
- Billing periods may be monthly, annual, or as otherwise specified
- All payments are in U.S. dollars unless otherwise stated
6.3 Free Trials
We may offer free trials for new subscribers. At the end of the trial period, you will be automatically charged unless you cancel before the trial ends.
6.4 Auto-Renewal and Cancellation
Auto-Renewal
Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period.
How to Cancel Your Subscription
To cancel your Wizify subscription:
- Open the Settings app on your iPhone or iPad
- Tap your name at the top
- Tap Subscriptions
- Select Wizify from the list
- Tap Cancel Subscription
Alternatively, you can manage subscriptions through the App Store app:
- Open App Store → Tap your profile icon → Subscriptions → Wizify → Cancel
Important:
- Cancellation takes effect at the end of your current billing period
- You will retain access to premium features until your subscription expires
- No partial refunds are provided for unused time in the current billing period

6.5 Refunds
Refund Policy
- All purchases are final unless otherwise required by applicable law
- Refunds are handled solely by Apple according to their refund policy
- We do not control Apple's refund decisions and cannot process refunds directly

- Sign in with your Apple ID
- Find your Wizify purchase
- Select "Report a Problem" and follow the instructions

If you have questions about charges or billing issues, contact us at support@wizifyapp.com. While we cannot process refunds directly, we can help clarify charges and assist with account issues.
6.6 Price Changes
We may change subscription prices at any time. Price changes will apply to new subscriptions and renewals after notice is provided.
6.7 Taxes
Prices exclude applicable taxes unless otherwise stated. You are responsible for all taxes associated with your subscription.
7. Apple Health Integration
7.1 Permission Requirements
Wizify integrates with Apple Health to access your health and fitness data. You must explicitly grant permission for each data type through iOS Settings.
7.2 How We Use Apple Health Data
We use Apple Health data to:
- Track activity-based habits (workouts, steps, activity rings, etc.)
- Display progress and insights in your habit tracking
- Calculate statistics and achievements related to your habits
- Share with your followers (if you enable social features) - see Section 7.4
7.3 Data Storage and Sync
- Local Storage: Apple Health data is stored locally on your device
- Backend Sync: Health metrics are synced to our secure servers for multi-device functionality and to enable social features
- Apple's Infrastructure: Integrates with Apple's secure health data ecosystem
7.4 Social Features and Apple Health Data
If you enable social features and allow followers:
- Your health and activity metrics may be visible to your followers within the app
- This can include: workouts, activity rings (move/exercise/stand), steps, distance, calories, and any other health data you've authorized Wizify to access
- You can hide individual metrics from your public profile, top metrics, and leaderboards via App Settings → Privacy Settings → Hidden Metrics
- You control what data Wizify can access through iOS Settings → Health → Wizify
- You control who can follow you through privacy settings (private profile, blocking, etc.)
- See Privacy Policy Section 6.4 for detailed privacy controls
7.5 Third-Party Data Restrictions
In accordance with Apple's Apple Health terms:
- We never share Apple Health data with third parties (including advertisers or data brokers)
- We do not use Apple Health data for advertising or marketing purposes
- We do not sell Apple Health data
- Sharing with your followers is an in-app social feature, not third-party sharing
7.6 Accuracy Disclaimer
While we strive for accuracy, Apple Health data may contain errors. You should not rely solely on Wizify for medical decisions.
8. User Content and Conduct
8.1 Your Content
You retain ownership of all content you create in the App (habits, notes, etc.). By using the App, you grant us a limited license to store, process, and display your content solely to provide the service.
8.2 Content Restrictions
You agree not to upload, post, or transmit content that:
- Is illegal, harmful, threatening, abusive, or offensive
- Violates intellectual property rights
- Contains malware, viruses, or harmful code
- Impersonates others or misrepresents your affiliation
- Contains personal information of others without consent
8.3 Prohibited Activities
You agree not to:
- Reverse engineer, decompile, or disassemble the App
- Circumvent security features or access restrictions
- Use automated systems (bots, scrapers) to access the App
- Interfere with or disrupt the App's functionality
- Attempt to gain unauthorized access to our systems
- Use the App for any illegal purpose
- Violate any applicable laws or regulations
- Resell, redistribute, or commercially exploit the App
8.4 Enforcement
We reserve the right to remove content or suspend accounts that violate these Terms, without notice.
9. Intellectual Property
9.1 Ownership
The App, including its design, code, features, graphics, and content (excluding user content), is owned by Wizify LLC and protected by copyright, trademark, and other intellectual property laws.
9.2 License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
9.3 Restrictions
You may not:
- Copy, modify, or create derivative works of the App
- Sell, rent, lease, or sublicense the App
- Remove or alter proprietary notices
- Use our trademarks without written permission
9.4 Feedback
If you provide feedback, suggestions, or ideas about the App, you grant us the right to use them without compensation or attribution.
10. Privacy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to our data practices as described in the Privacy Policy.

11. Disclaimers
11.1 No Medical Advice
WIZIFY IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.
The App is designed for general wellness and habit tracking purposes only. It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
Always consult a qualified healthcare professional before:
- Starting a new fitness program
- Making dietary changes
- Relying on health data for medical decisions
- Taking any action based on App information
11.2 Accuracy of Information
While we strive for accuracy, we do not warrant that:
- The App will be error-free or uninterrupted
- Apple Health data will be accurate or complete
- Results or insights will be reliable
- Defects will be corrected promptly
11.3 Third-Party Services
The App integrates with third-party services (Apple Health, RevenueCat, etc.). We are not responsible for:
- The availability, accuracy, or reliability of third-party services
- Changes to third-party services that affect the App
- Third-party terms and policies
11.4 User Responsibility
You are solely responsible for:
- Your use of the App and any actions you take based on App data
- Verifying the accuracy of information
- Maintaining appropriate backups of your data
- Ensuring compliance with applicable laws
12. Limitation of Liability
12.1 Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY.
12.2 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GRILLO TECHNOLOGIES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Service interruptions or errors
- Unauthorized access to your data
- Third-party actions or content
- Any damages arising from your use or inability to use the App
EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12.3 Maximum Liability
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF:
- The amount you paid us in the 12 months before the claim, or
- $100 USD
12.4 State Law Variations
Some jurisdictions do not allow exclusions or limitations of liability, so the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Wizify LLC, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any law or rights of third parties
- Your content or conduct
- Your Apple Health data or any reliance on App health information
14. Termination
14.1 Termination by You
You may terminate your account at any time by deleting it through the App settings.
14.2 Termination by Us
We may suspend or terminate your account and access to the App at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent, illegal, or harmful activity
- Extended periods of inactivity
- Legal or regulatory requirements
- Discontinuation of the App
14.3 Effect of Termination
Upon termination:
- Your right to use the App immediately ceases
- Your data will be deleted in accordance with our Privacy Policy
- Active subscriptions will continue until the end of the current billing period (no refunds for partial periods)
- Sections of these Terms that by their nature should survive (including liability limitations, indemnification, and dispute resolution) will remain in effect
15. Dispute Resolution
15.1 Informal Resolution
Before filing a claim, you agree to contact us at legal@wizifyapp.com to attempt to resolve the dispute informally. We will attempt to resolve disputes within 60 days.
15.2 Binding Arbitration
If informal resolution fails, you agree that disputes will be resolved through binding arbitration rather than in court, except for disputes that may be brought in small claims court.
Arbitration Terms:
- Conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules
- Arbitrator's decision is final and binding
- Arbitration will be held in Florida or remotely (via videoconference or telephone)
- Each party pays its own costs, except we will pay filing fees if required by AAA rules
15.3 Class Action Waiver
YOU AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.
15.4 Exceptions
Either party may seek injunctive relief in court for:
- Intellectual property violations
- Unauthorized access or misuse of the App
- Enforcement of arbitration provisions
15.5 Opt-Out
You may opt out of arbitration by sending written notice to legal@wizifyapp.com within 30 days of first using the App. If you opt out, disputes will be resolved in court.
16. Governing Law and Jurisdiction
16.1 Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.
16.2 Jurisdiction
For disputes not subject to arbitration, you agree to the exclusive jurisdiction of state and federal courts located in Hillsborough County, Florida.
16.3 International Users
If you access the App from outside the United States, you are responsible for compliance with local laws.
17. Apple App Store Terms
17.1 Acknowledgment
You acknowledge that these Terms are between you and Wizify LLC, not Apple, and Apple is not responsible for the App or its content.
17.2 License Scope
Your license to use the App is limited to a non-transferable license to use the App on Apple-branded products you own or control, as permitted by Apple's Usage Rules.
17.3 Maintenance and Support
We, not Apple, are solely responsible for providing maintenance and support for the App as specified in these Terms, or as required by law.
17.4 Warranty
Apple has no warranty obligation for the App. Any claims, losses, liabilities, damages, costs, or expenses attributable to failure to conform to any warranty will be our responsibility, not Apple's.
17.5 Product Claims
We, not Apple, are responsible for addressing any claims relating to the App or your use of it, including:
- Product liability claims
- Claims that the App fails to conform to legal or regulatory requirements
- Consumer protection claims
17.6 Intellectual Property
Apple is not responsible for investigating, defending, or settling any third-party claim that the App infringes intellectual property rights.
17.7 Third-Party Beneficiary
Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you.
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wizify LLC regarding the App.
18.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
18.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
18.4 Assignment
You may not assign or transfer these Terms or your account. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
18.5 No Agency
These Terms do not create a partnership, joint venture, employment, or agency relationship between you and us.
18.6 Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
18.7 Export Control
You agree to comply with all applicable export and import laws and regulations. You may not use the App if you are in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, or if you are on a U.S. Government restricted parties list.
18.8 Notices
We may provide notices to you via email, in-app notifications, or by posting on our website. You may provide notices to us at legal@wizifyapp.com.
